Georgia Fatal Pedestrian Crashes
The Georgia Governor’s Office of Highway Safety reports that between 2000 and 2008, 18,383 pedestrians were hurt, and 1,390 more lost their lives in car accidents. Accidents involving pedestrians can happen for a variety of reasons, but driver irresponsibility is the main cause of these incidents. Nonetheless, injured pedestrians may have the right to file a claim against the responsible party and request damages compensation.
In Georgia, there are two types of negligent death claims. The first is a typical wrongful death claim made by the decedent’s survivors (children, parents, or other legal heirs), and it aims to recover the full value of the decedent’s life from the decedent’s perspective. This covers both physical losses, like the decedent’s pleasure of life as well as intangibles, such as economic harm, like the decedent’s projected lifetime earnings. These things are decided by the jury. Georgia does not factor in the grieving of the decedent’s remaining relatives when determining these components, but there is no standard formula. If you want to see if you are able to file a claim, it is advised you talk with an attorney with the right experience.
