Fatal Head-On Collisions in Georgia
Cars traveling in opposing directions collide front to front in a head-on collision, sometimes known as a frontal crash. A head-on collision is more likely than other collisions to seriously hurt or kill the driver or passengers in either vehicle, according to data. In 2017, frontal impact incidents resulted in a 58% death rate for car occupants, according to the Insurance Institute for Highway Safety.
There are two categories of claims for negligent death in Georgia. The first is a conventional wrongful death claim, which is brought by the decedent’s survivors (children, parents, or other legal heirs), and which seeks the full value of the life of the decedent from the decedent’s standpoint. This includes both concrete losses, like the decedent’s enjoyment of life, and intangibles, like economic damages, such as the estimated lifetime income of the decedent. A jury decides on these factors. The grieving of the decedent’s surviving family members is not taken into account in Georgia’s calculation of these components, but there is no set methodology.
