The grieving process after the death of a loved one is never an easy or straightforward journey to take. It is possible that it will be especially difficult if you believe that the tragedy could have been averted if the reckless party had performed appropriately instead of being careless. You have the legal right to file a claim for compensation against the negligent party if the activities of the negligent party resulted in the death of a close friend of yours or a member of your family. Regardless of whether the offender is a company or an individual, we will take the necessary steps to ensure that they are held responsible for the harm that they have caused.
If it can be demonstrated that someone died as a result of another person’s acts, whether those actions were negligent or malicious, wrongful death claims may be made under South Carolina law. The lawsuit may be brought on behalf of the deceased by their surviving partner and children. In the absence of a spouse or children, the deceased person’s parents may file a lawsuit on their behalf. The heirs stand to benefit financially from any legal action brought if the deceased did not leave behind a spouse, children, or parents.
