Anyone who has been hurt or lost property in a vehicle accident due to the negligence or carelessness of another driver is eligible to file a claim for compensation. It is the burden of the injured party to prove that the negligent party owed them a duty of care, that the negligent party violated that duty of care, that the violation led to the accident, and that the accident actually resulted in injuries. In other words, it is up to the injured party to prove that the careless party owed them a duty of care.
