Fatal Pedestrian Accidents in South Carolina

Last year, South Carolina continued a disturbing pattern of record-high pedestrian fatalities. The state has the greatest frequency of pedestrian accident fatalities per capita in the United States. These conclusions are supported by a recent examination by the Governor’s Highway Safety Administration. In the first half of 2018, there were 17% more pedestrian fatalities in the United States than during the same period in 2020. Pedestrians have the possibility of suffering fatal injuries in the event of a traffic accident.
Under South Carolina law, wrongful death claims may be established if it can be shown that someone died as a result of another person’s conduct, whether those actions were negligent or intentional. The surviving partner and children of the deceased party may be able to file the lawsuit on their behalf. The deceased person’s parents may launch a lawsuit on their behalf if there is no heir or spouse.
When a family member dies unexpectedly and without notice, it is completely devastating. Anytime there is even the slightest possibility that a fatality may have been caused by someone else’s negligence, recklessness, or criminal intent, an investigation must be opened. You might be qualified to launch a lawsuit against the culpable parties for monetary damages if a loved one passes away in a car accident. You might be able to utilize this to replace the income of the main earner, cover your funeral and medical costs, and get money for the emotional pain you’ve had due to the loss.
