Fatal Head-On Collisions in South Carolina
Due to the tremendous force experienced by both drivers in head-on collision crashes, they are perhaps the most deadly kind of collisions. In contrast to other collisions, this one occurs as two cars are moving in the other direction. Only 2% of collisions, according to statistics, are head-on collisions, but they are responsible for considerably over 10% of traffic fatalities.
Under South Carolina law, wrongful death claims may be made if it can be proven that someone died as a result of another person’s conduct, whether those actions were negligent or intentional. The deceased’s surviving spouse and children may file the lawsuit on their behalf. If the deceased person has no surviving spouse or children, their parents may bring a lawsuit on their behalf. If the dead did not leave behind a spouse, children, or parents, the heirs stand to gain financially from any legal action taken.
