Can I hold the delivery company responsible if the driver was an independent contractor?

Generally, companies are not vicariously liable for the actions of independent contractors, such as Uber Eats or DoorDash drivers. However, in Maine, an attorney can pursue compensation from the corporate third-party liability policy that is active when the driver has accepted a delivery, or prove the company committed negligent hiring.

What if the defense claims I was partially at fault for the Portland delivery accident?

Maine follows a modified comparative negligence rule (14 M.R.S. § 156). You can still recover financial compensation as long as you were less than 50% at fault for the collision. If a jury finds you “equally at fault” (50% or more), you are barred from recovering any damages.
