You must understand who can file a claim and when a wrongful death claim is appropriate in South Carolina. When the defendant — the at-fault party — was the direct cause of the decedent’s death, a wrongful death lawsuit is appropriate under the wrongful death statute. The decedent’s representative should file the claim, which is an attempt to establish the defendant’s negligence.
