The Centers for Disease Control and Prevention estimate that over 30,000 Americans lose their lives in car accidents each year. About $41 billion in medical costs and missed earnings were incurred in 2005 by accident victims and their loved ones. In South Carolina, driving is very dangerous and results in tens of thousands of injuries each year. To ensure that they are able to protect their legal rights, those who have been affected by these terrible accidents should seek the assistance of a lawyer.
Once a family member passes away, you must be prepared to protect your family from the countless unforeseen costs that could result from wrongful death. You can get help from your lawyer to understand the complex legal processes involved in a wrongful death case. The executor of the estate may add a survival motion to claims brought on behalf of the estate in a wrongful death case. The viability of a claim depends on how much pain and suffering the deceased would have undergone had they lived.
As wrongful death attorneys in South Carolina, we have assisted neighborhood families who have lost a loved one in an accident. When a person in the state passes away as a result of an accident, there are two distinct legal claims that may be asserted. The surviving family members and beneficiaries of a deceased person may file a claim in the first category of claims, known as a wrongful death action, in order to be made whole for their loss.
