If you have lost a loved one in a fatal car accident, a wrongful death claim may be able to compensate you financially. You must understand who can file a claim and when a wrongful death claim is appropriate in South Carolina. A wrongful death lawsuit is appropriate under the wrongful death statute when an at-fault party was the direct cause of the victim’s death. The claim should be filed with a representative of the deceased party to establish the defendant’s negligence.
