Sometimes, we abruptly lose loved ones far earlier than planned and much earlier than they had the opportunity to enjoy their lives to the fullest. However, not every terrible loss may be considered a case of wrongful death. According to the laws of South Carolina, wrongful death is considered to have occurred when the unlawful conduct, negligence, or default of another led to the death of another person. If your loved one had survived the injuries, South Carolina law requires that they have grounds to sue a person or other party for damages linked to the injuries in order to be able to file a lawsuit against that person or party.
You may compare a claim for wrongful death to a personal injury lawsuit in that it involves someone bringing legal action against a culpable party on behalf of the dead individual. In point of fact, family members who are entitled to launch a case must retain the services of an attorney in order to do so. In South Carolina, family members cannot sue directly for damages.
