South Carolina Fatal Pedestrian Crashes

Galivants Ferry, SC - Ronald Hewitt Fatally Hit Working in Yard on Gunters Island Rd

You might be shocked to learn that more than 10% of the fatalities in vehicle accidents in South Carolina occur to pedestrians each year. A total of 113 of the 828 persons who perished in vehicle accidents in our state, according to the National Highway Traffic Safety Administration’s most recent annual tally, were on foot, walking, running, jogging, hiking, sitting, or lying down close to or on a roadway.

Accidents involving automobiles provide the same risks of death and injury to pedestrians as they do to motorists, passengers, and cyclists. The majority of the time, it is due to the carelessness or recklessness of the driver. In the event that such an accident does place, the pedestrian who is hurt or the family of a pedestrian who was killed may be eligible to receive compensation for their losses.

A person is said to have suffered a wrongful death if they passed away as a direct result of the carelessness, recklessness, or malice of another person or party. It is possible for the personal representative of the decedent’s estate to file a wrongful death case on behalf of the “distributees.” These are often members of the decedent’s immediate family. The family may be entitled to share in any damages that are awarded as a result of the action.
