Zenith Financial Group Shuts down Their Services

Zenith Financial Group’s owner, Earnest Earvin IV, an Atlanta and surrounding area debt collector, announced this week that he has been in agreement with The Georgia Consumer Protection Office to shut down their services due to illegal debt-collection.

Zenith Financial Group had 33 complaints filed with the Better Business Bureau in the past three years accusing the company of threatening to physically assault, arrest and charge consumers as criminals if the debt was not paid. Many of which have stated that the debt wasn’t real in the first place. Per the agreement with the Protection Office, Earnest and Zenith, must refrain from working in the collections business for 5 years and will not be able to collect $3.1 million in supposed debts. Earnest must pay $15,000 now and $445,000 immediately if the agreement is broken.

In any way debt collectors contact the borrower by phone, email or text message they must follow the strict limits enforced by the law. Every collection agency must send a written notice with amount owed, name of creditor and how to dispute or verify the debt within five business days. They cannot make contact after 9:00 p.m. or before 8:00 a.m. Collectors cannot claim that the debtors have committed a crime, threaten to arrest them or misrepresent the amount owed.
