If you have lost a loved one in a deadly car crash, you may want to consider pursuing a wrongful death claim. You need to know who can bring forth a claim in South Carolina and when a wrongful death claim is appropriate. Under the wrongful death statute, a wrongful death lawsuit is appropriate when the negligence of the defendant — the at-fault party — was the direct cause of the decedent’s death. The claim should be filed by the representative of the decedent and is an attempt to establish negligence on part of the defendant.
