Uninsured / Underinsured Motorist (UM / UIM) Claims

Georgia law requires drivers to carry minimum liability limits of $25,000 per person and $50,000 per accident. They must also carry $25,000 in property damage coverage. This amount often fails to cover a driver’s total losses, particularly in a crash that results in serious injury or death.

The Insurance Research Council estimates that 25 percent of all motorists drive without insurance. The problem of uninsured and underinsured motorists is so serious that Georgia passed laws allowing drivers to buy additional coverage for protection in these situations.  Such “add-on” or “stackable” UM / UIM coverage is available in addition to traditional (“non-stackable”) under-insurance coverage.

Drivers involved in a wreck caused by another motorist can draw upon UM / UIM coverage when the other driver either doesn’t have liability insurance or doesn’t have enough insurance to cover their losses. A UM / UIM insurance policy can help an injured motorist to recover or help a family whose breadwinner has been killed in an accident.

But a UM / UIM insurance policy – or any automobile insurance policy – is only helpful when the insurance company promptly pays the injured motorist’s claim. Insurance companies stay in business by collecting more money in insurance premiums than they pay out for insurance claims. They have a variety of ways to delay action, obscure policy details and short-change policy holders. They may also reject and deny legitimate insurance claims.
